FAQs
What is article 16? Why should I vote no?
Article 16 is the resurrection of Conway’s defunct (paused) rental inspection program that is as flawed in its new iteration as it was when the Assoc filed suit against it last July, leading Conway to at least temporarily scrap the program without refunding taxpayers that had already paid into the suddenly non-existent program. The added concern with this updated version of the inspection program is the emphasis on ALL dwellings. Article 16 reads like a rental only inspection program. Not true. As reported by the Conway Daily Sun, Zoning Officer Nicholas DeVito and Planner Ryan O'Connor interpret the inspection program to mean if there is a change of ownership or a major renovation to any dwelling, including full-time residential homes, a physical inspection would be triggered.
Vote NO because warrantless inspections in New Hampshire are illegal and why should you invite an official into your home.
What is article 55 & 56? Why should I vote yes?
Article 55 offers voters a chance to end Conway’s continued and unconstitutional attempts to inspect private dwellings, including the single-family homes of full-time residents. Upcoming NH Senate Bill 188 proposes to allow third-party inspectors to be hired by property owners, ending what the Senate sees as invasive government intrusion through inspection programs like Conway’s. Help Conway help itself by voting YES and voting the inspection program down before the state must step in. The people of Conway can protect their own rights.
Article 56 proposes a one-time self-affidavit for rental properties, both short and long term. This limits government intrusion, while addressing the life safety concerns the town claims to have. The town’s self-affidavit is an ongoing revenue stream with unjustifiably high annual cost to property owners. The state prohibits towns from raising such revenues. Article 56 is proposing a legal means of inspection for Conway.
